General Terms and Conditions for Participation in Contests and Giveaways

1. Organizer

Organizer: sounds2feel, Graf-Gottfried-Straße 70A, 59755 Arnsberg, info@sounds2feel.de (“Organizer”). Participation is subject exclusively to the following terms and conditions.

2. Participation

a) Participation is open to all natural persons aged 18 and over residing in Germany. Employees of the organizer and their direct relatives are excluded.
b) Participation is only possible within the specific period stated for each contest.
c) Participation is free of charge and does not require the purchase of goods or services.
d) Only fully completed entries that meet all requirements stated for the contest will be considered. Incorrect or incomplete entries will not be accepted. The organizer is not responsible for late or lost entries.
e) By participating in a contest, entrants agree to these terms and conditions.

3. Execution and Processing

a) The prize described in the respective contest will be drawn among all valid entries.
b) Each contest begins on the date of publication and ends on the date indicated on the campaign page.
c) Winners will be selected after the contest ends and notified via direct message on Instagram or Twitch. The winner must confirm receipt of the notification and acceptance of the prize within two weeks using the contact method specified in the message. If confirmation is not received, the prize will be awarded to another participant.
d) The claim to the prize also expires if the delivery cannot be completed within four weeks after the first notification for reasons attributable to the winner. Delivery is only possible within Germany. If it becomes known after the draw that the winner does not have a valid postal address in Germany, the prize will be reassigned.
e) The prize is non-transferable and cannot be exchanged or paid out in cash unless expressly stated otherwise. If the prize cannot be provided for any reason, the organizer reserves the right to award an equivalent substitute prize.

a) In case of violation of these terms, the organizer reserves the right to exclude participants.
b) The organizer may also exclude participants who use unauthorized aids or attempt to gain advantages through manipulation, such as multiple entries, bots, or fake profiles. Prizes may be revoked or reclaimed in such cases.

5. Premature Termination or Modification

The organizer reserves the right to cancel, suspend, or modify the contest if unforeseen circumstances arise beyond its control that make proper execution difficult or unreasonable. Such circumstances include, but are not limited to, unauthorized interference by third parties, technical issues with hardware or software, or legal infringements related to the contest.

a) The contest is in no way sponsored, endorsed, administered by, or associated with Facebook.
b) Participants have no claims against Facebook arising from participation or prize receipt.
c) All inquiries or complaints should be directed solely to the organizer.

7. Twitter

a) The contest is in no way sponsored, endorsed, administered by, or associated with Twitter. Participants have no claims against Twitter.
b) Participants may not enter using multiple accounts. Creating several accounts to increase winning chances is prohibited.

When participating in a contest, the organizer collects the following data:
– First and last name and title
– Date of birth
– Postal address
– Twitch/Instagram username
This data is used exclusively for determining the winner, verifying eligibility, and delivering the prize. Processing is based on Article 6(1)(b) GDPR.
In most cases, the prize will be sent directly by a partner; for this purpose, personal data may be shared with that partner. By participating, the entrant consents to this.
The organizer will delete the winner’s data once it is no longer needed for these purposes, typically after the prize has been delivered and confirmed.
Participants have the right to request information, correction, deletion, or restriction of their stored data at any time in accordance with Articles 15–18 GDPR. They also have the right to object to processing under Article 21 GDPR and to file a complaint with the competent supervisory authority.

9. Organizer’s Liability

The organizer’s liability for damages is limited as follows:
a) The organizer is fully liable for damages caused by intent or gross negligence.
b) For slightly negligent breaches of essential contractual obligations, liability is limited to foreseeable, typical damages.

d) These limitations do not apply to damages resulting from injury to life, body, or health, or for guarantees of product quality or fraudulent concealment of defects. Liability under the Product Liability Act remains unaffected.
e) These limitations also apply to the personal liability of the organizer’s representatives, employees, and agents.

a) Legal recourse is excluded.
b) German law applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
c) Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
